DUNNIGAN, Calif. -- The man accused of shooting and killing a Yolo County Sheriff's deputy will answer to first-degree murder charges Wednesday in court.Deputies said Marco Antonio Topete shot Deputy Tony Diaz, 37, Sunday night outside of Dunnigan.The deputy later died at Woodland Memorial Hospital.Those who knew Diaz describe him as a gentle and sensitive man who had fulfilled his dream of becoming an officer. He was the father of three girls -- ages 2, 4 and 16.Investigators will be studying dash-cam video captured by the deputy's police car for evidence related to the shooting.Topete was captured Monday morning following a massive manhunt that lasted several hours.Sheriff Ed Prieto said Topete had ties to gangs and served 12 years in prison for shooting another person.
